Terms and Conditions

Easy Returns:

We are happy to exchange or refund products within 28 days provided that the product is returned with a valid invoice or and;

  • is unopened and unused
  • in original condition and packaging
  • includes all accessories
  • is not a customised item

Customised products, which include products cut, made-to-measure, cannot be refunded or exchanged.

We will refund to your original payment method where possible for cost of the product excluding handling and any delivery or returns costs.

Faulty Goods:

If a problem occurs with a product purchased, return it to us with your proof of purchase. We will either repair, replace or provide you with a refund, as set out in the Consumer Guarantees Act.

Cancelling Your Order:

If you wish to cancel your order you will need to contact us on the contact us form. We cannot guarantee that it will be possible to cancel your order as it may have already been processed.

If we are able to cancel your order prior to dispatch, we will refund to your original payment method where possible

We’re committed to treating personal information with care and respect. 

This Privacy Policy relates to Custom Cushions. (collectively referred to as “Custom Cushions”, “we” or “us”). 

This Privacy Policy explains how Custom Cushions collects, stores, uses and discloses personal information about its customers and suppliers. We strive to take a consistent approach to privacy practice but may occasionally handle personal information differently. We will tell you before collecting, using or disclosing personal information in ways not covered by this policy. 

Information we collect from you

Most of the personal information we collect about you is provided by you directly during your interactions with us on our website, www.customcushions.co.nz,

We always take care to ensure that we only collect personal information needed to provide our services and help run our business. The types of personal information we may collect include:

  • Social contact information, including any communications via social media, complaints, feedback and other contact you have with us. 
  • Contact and similar information if you are a supplier or service provider, in connection with the supply of products and services by your business to Custom Cushions.
  • Digital information, such as cookies, pixels, software versions used, device identifiers (like IP address), location data (where available and not disabled by the user), dates, times, file metadata, referring website, data entered, and user activity such as links clicked, app installations, app launches, viewing items and content pages, adding items to a basket, adding items to a wish list and making purchases. 

Information we collect from others

In certain circumstances, we may also collect personal information about you from third parties. 

We’ll only do this if you’ve been told first, where permitted by law or where you have authorised another agency to share that information. It is important that you read the privacy policies for all agencies you deal with, as you may be permitting the sharing of personal information with us when using those services. 

In particular, we may collect personal information about you in the following ways: 

  • Publicly available sources -  including from agencies such as the Companies Office, NZBN Register, internet search platforms and social media platforms, such as Facebook and Linkedin. 
  • Credit reporters – If you apply for a trade account or other account with us, we may collect credit information about you with your consent. This information helps us to assess your application for credit. 

How we use personal information

·       We primarily use the personal information we collect about you to ensure that you receive the best products and services from us.

We may use your personal information for the following purposes: 

  • To fulfil orders and deliver products and services to you. 
  • Managing our relationship with you, including contacting you about your purchases and/or account. 
  • To assess any application that you make to us for a Trade account or other account. 
  • Considering feedback and complaints that you may make to us. 
  • To personalise and customise your experience with Custom Cushions and to tailor how we market our products and services to you (including the layout and content of our website / apps, and advertisements displayed to you on or via third party website, apps or platforms) based on your purchase history and shopping preferences.   
  • To undertake data processing, data analysis, market research or trend analysis. 
  • In the case of our suppliers, to manage the supply of products and services to us and our customers. 
  • Managing and monitoring our risks, including:
    • ensuring the safety of our customers and team members; 
    • identifying and investigating health and safety hazards or incidents; 
    • undertaking product recalls; 
    • recovering any unpaid debts or other monies owing; and 
    • complying with our legal and regulatory obligations and any lawful requests from government agencies or regulators. 

We may also use your personal information for other purposes, either after notifying you at the time of collection or where those uses are otherwise permitted by law.

Sometimes, we need to disclose personal information to third parties in order to carry on our business. 

As noted above, Custom Cushions may share personal information from time to time where permitted by law and/or as otherwise set out in this privacy policy.

  • Trusted third parties involved in providing products and services to you, such as product suppliers, couriers, tradespeople and installers. 
  • Our trusted service providers, who provide other administrative and operational services to us in connection with our business, such as IT service providers, advertising agencies and payment processers. 
  • Third party platforms who serve advertising or content (including personalised advertising) based on your personal information or preferences (including social media platforms such as Facebook). 
  • Debt collection agencies or credit reporters as part of the account set up and debt recovery process. 
  • Our professional advisers, where required to enable any such adviser to provide services to us. 
  • Other persons disclosed to you at the time the relevant personal information is collected. 

How we keep your personal information secure

The personal information we collect about you is held by Custom Cushions, and by our trusted data storage providers (which may include storage in ‘cloud’ facilities). 

We take all reasonable steps to ensure that the personal information we hold is protected against loss, unauthorised use, access or disclosure and any other misuse, and we require our trusted service providers to do the same, even where they may store or process personal information overseas. However, please note that whilst we take appropriate technical and organisational measures to safeguard the personal information that you provide to us, no electronic transmission or storage can ever be guaranteed secure. 

We retain your personal information only for as long as we need it and we destroy the information we no longer need in a secure manner.

Our website may contain links to other websites for your convenience and information. These websites may be operated by businesses not affiliated with us. Linked websites may have their own privacy statement, which we suggest you review if you visit them. 

We are not responsible for the content of any websites that we do not control, any use of those websites or the privacy practices of those businesses.

We want our advertising and information on our websites and related services to be relevant and interesting.

From time to time we may update this Privacy Policy, to reflect changes to our business, products or services or changes to the Privacy Act. Acceptance of Terms

When you access this site, you acknowledge that you have read and agree to the terms described below. If you do not agree to the terms discussed here, you should exit the site and refrain from placing any order.

Contract, Payment and Delivery all within New Zealand

Orders will only be accepted by Custom Cushions, New Zealand and payment is to be made in New Zealand currency. Any contract arising from this site is governed by the laws of New Zealand. Custom Cushions will deliver goods only within New Zealand.

Product Availability

Product may be added to or removed from the site from time to time. From time to time products described on the site may not be available. While Custom Cushions does not accept liability for any loss arising, every effort will be made to keep the information up to date and accurate.

Use of Cookies

Some pages on this site use “cookies” which are small files that the site places on your hard drive for identification purposes. These files are used for site registration and customisation the next time you visit us. You should note that cookies cannot read data on your hard drive. Your web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. If you do not accept cookies, some pages may not function fully and you may not be able to access certain information on the site.

Orders, Price and Payment

Products may be ordered by following the instructions on the catalogue pages of this site. All prices quoted include Goods and Services Tax. Prices may increase or decrease from time to time.

You must pay by credit card or by bank transfer as arranged.

Your card details are delivered immediately to a secure ecommerce server and our bank immediately debits your card for the cost of the items ordered and of delivery. If Custom Cushions is unable to deliver any items, your credit or debit card will be credited with the full cost and delivery charge for that item debited when the order was placed.

Order Fulfilment

Delivery charges within mainland North Island and South Island will be calculated for each order and shown as a separate item before you chose to enter your payment details and send the order to be processed. Delivery will be by courier or by any delivery service as chosen by Custom Cushions.

For delivery to an offshore island of New Zealand please enter the details of the shipping agent at the pick-up point on the mainland at which it would be convenient for you to have the order delivered to. Custom Cushions responsibility for product shall cease on delivery of the order to your nominated shipping agent.

Offer and Acceptance of Order

When you place an order with us, you are making an offer to buy goods. This occurs when you place your order on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and any other relevant details for your order, including entering payment information and submitting your order. The final step consists of a confirmation page with full details of your order, which you are able to print as a receipt of your order.

We will take payment from you when we accept your order.

Order Status and Notification

We will send you an e-mail to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it.

We may communicate with you regarding your account and orders using your email address, phone number (including text message) and other forms of communications that may reasonably become available to us.

Risk

Goods are at our risk until delivered to you, or in the case of an offshore island address, until delivered to your shipping agent. We may deliver each item ordered separately if we choose for supply or other reasons. If this is the case you will not incur any extra delivery cost.

While we try to ensure that the price and description of goods or services is accurate, if there is an error with the listing a product on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.

Our right to cancel orders applies to orders that have been accepted.

Disclaimer. Limitation of Liability and Indemnity

To the extent permitted by law, we exclude all liability to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to the website including, but not limited to, loss or damage you might suffer as a result of:

Errors, mistakes or inaccuracies on the website;

You acting, or failing to act, on any information contained on or referred to on the website or any linked website;

Personal injury or property damage of any kind resulting from your access or use of the website;

Any unauthorised access to or use of the websites secure servers;

Any interruption or cessation of transmission to or from the website;

Routine Security Checks

Custom Cushions reserves the right to contact the purchaser of an order to confirm the validity of delivery details supplied and we will perform security checks on any orders that raise a security alert based on purchase type or level. Custom Cushions reserves the right to cancel and refund any order that appears to be fraudulent.
